Motivation of marginal valid behaviour
Abstract. In the paper the motives of legitimate behaviour and specially the motives of marginal (law-abiding) legitimate behaviour have been analysed. The historical and modern views on the problem of constraining force of the legal sanctions and their realisation in law enforcement practice have been considered. The miscellaneous factors influencing on the legal sanction effectiveness from the point of view of both special and communal prevention of unlawful behaviour have been highlighted.
